Your questions, answered

What makes a Will legally valid in England & Wales?

To be valid, you must be 18 or over and of sound mind, the Will must be in writing, and you must sign it (or acknowledge your signature) in the presence of two witnesses who are both present at the same time. Those two witnesses must then sign in your presence. Importantly, a witness — or their husband, wife or civil partner — cannot benefit from the Will, so we'll guide you on choosing suitable, independent witnesses.

What happens if I die without a Will?

You would be said to die "intestate", and the law's intestacy rules decide who inherits — following a strict legal order. This can exclude people you'd want to provide for, such as an unmarried partner or stepchildren, and it can cause delay and added stress for your loved ones. A Will puts you back in control.

Can I appoint guardians for my children?

Yes. If you have children under 18, your Will lets you name the people you'd want to care for them. Without a Will, decisions about your children's care could ultimately be left to the courts.

Do I need a solicitor to make a Will?

There's no legal requirement to use a solicitor to make a Will in England & Wales. Our guided process is designed for straightforward estates. If your circumstances are more complex — for example, business interests, trusts, overseas assets or potential disputes — we'll let you know and can point you towards specialist advice.

Is a Will the same as a Lasting Power of Attorney?

No. A Will sets out your wishes after you pass away. A Lasting Power of Attorney (LPA) lets people you trust make decisions on your behalf during your lifetime if you become unable to. Many people choose to put both in place — ask us if you'd like to know more.

Can I update my Will later?

Yes. Life changes — marriage, children, new property or relationships — and your Will should keep pace. We make it easy to review and update your wishes whenever you need to.
